PROTECTION NOTICE
Freebird Airlines Europe Ltd.
and Freebird Airlines Flight Services GmbH are committed to protect the privacy
and safeguarding of personal data. According to the
General Data Protection Regulation EU 2016/679 (“GDPR”), Freebird
Airlines Europe Ltd. and/or “Freebird Airlines Flight Services GmbH” (hereinafter
referred as “we” or “company”) data controller, are
required to notify you about the information contained in this data protection
notice. Company is committed to ensure that the personal
data of job applicants is handled with care and in accordance with the
principles set out in GDPR.
This notice describes which personal data company collects from you as applicant,
why company collects your data, with whom company shares your personal data,
how and on what legal basis company collects personal data, how long company
usually keeps your personal data during and after your relationship with company.
This data protection notice also makes you aware of your rights under the GDPR.
It is important that you read and understand this notice. If you have

1. PERSONAL DATA TO BE COLLECTED
Within the scope of your relationship with the Company,
your below personal data will be processed;

Your Credentials: Name, surname, mother’s name,
father’s name, citizenship number, gender, country of birth, date of birth,
place of birth, nationality, copies of ID card and passport, marital status, military
status, wet signature, biometrical photograph,
Ø Your Contact Information: Mobile phone number, home phone number, private e-mail, residency
address,
Ø Information Relating to
Monitoring: CCTV records, photograph,
Ø Information Relating to Your
Performance and Training: Curriculum Vitae, educational
background, place of education, seminars, workshops and trainings attended,
training date and time, information about performance and career improvement,
general aptitude tests, personality inventory tests, foreign language levels
and scores, personal preferences, wage information, recruitment forms
(interview evaluation, reference evaluation),
Ø Information Relating to Your Employment: Information about your professional liffe, start date of
employment, previous company, title, details of salary, date of termination/resignation,
reasons and date of termination/resignation,
Ø Your Family Relatives’ Information: Name, surname, age of your first degree family
members,
Ø Information Relating to Your
Body: Body Measures (clothing - shoes
- height),
Ø Private Personal Data: Physical disability information,
medical attestation, information about regularly used medication, information
about your past and present illnesses, blood group, immunization,
psychotechnics evaluation results, criminal record information, abandum
conviction and security measure information.

2. PURPOSE OF PROCESSING PERSONAL DATA
Your personal
data obtained within the scope of your relationship with the Company are
processed for the purposes listed below.
Ø
Receiving and evaluating job applications,
Ø
Accountability against internal/external audit.
3. TRANSFER OF PERSONAL DATA
In order to comply with legislations, such
as a court decisions, Company will be legally obliged to transfer your personal
data with different government agencies and institutes. Company will transfer
your personal data with data processor who processes your personal data on
behalf of it. Company will also transfer your personal data with third parties,
such as legally authorized public authorities to receive
flight permissions and for the purpose of operational sustainability, subcontractors
like handling companies to conduct business operations, solution partners and suppliers
to get different types of insurance provided -such as health, travel-, IT
service & security providers, payroll providers, archiving providers, audit
companies to perform
contractual and legal obligations. In such cases, we will limit transferring of
the personal data at a minimum as required.

TRANSFER OF
PERSONAL DATA OUTSIDE THE EU
As an international establishment, if
necessary, the Company will transfer your personal data which is collected from
you to our joint entities in Turkey. We ensure that appropriate safeguards are
in place which provide adequate levels of protection of your personal data as
required by applicable data protection laws. All transfers outside the EU are
to be made to countries which are considered to provide an adequate level of
protection of personal data are safeguarded with agreement based on Standard
Contractual Clauses based approved by European Commission or such other
mechanisms as have been recognised or approved by the relevant authorities from

5. COLLECTION METHODS OF YOUR PERSONAL DATA
We collect your
personal data through the following sources.

Ø From government agencies and institutes,
Ø From an employment agency,
Ø From your employer if you are
a secondee,
Ø From referees, either external
or internal,
Ø From security clearance
providers,
Ø From occupational health and
other health providers,
Ø From your trade union,
Ø From providers of staff
benefits,
Ø CCTV images from our landlords
or taken using our own CCTV systems,
Ø Video and audio recordings
throughout our selection processes
6. LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA
Company relies on the
following legal basis for processing your personal data under the GDPR;
Ø Article 6(1)(b) which
relates to processing necessary for the performance of a contract,
Ø Article 6(1)(f) for
the purposes of Company’s legitimate interest.
Company relies on the
following legal basis for processing your private personal data under the GDPR;
Ø
Article 9(2)(b) which relates to an explicit consent given by you (as data subject)
towards one or more specific aim for processing of your special categories of
personal data.
Company relies on the
following legal basis for purpose of processing your personal data about
criminal convictions and offences under the GDPR;
Ø
Article 6(1)(b) for the performance of a contract.
7. PERSONAL DATA RETENTION
Company only retains your
personal data as long as the data is necessary to be stored for the purpose of fulfilling
or meeting any legal, accounting, or reporting requirements. Once you are no longer an applicant of the
company, Company will keep and then securely destroy your personal data in
accordance with company’s data retention policy and applicable laws and
regulations.
8. YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA
You have the following rights
in relation to your personal data in accordance with the provisions of section
3 of GDPR;
Ø Right to be
informed: organisations must describe individuals which
data of them are being collected, how they are being used, how long they will
be kept and whether they will be transferred to any third parties.
Ø Right of access: individuals have the right to request a copy of the information that an
organisation holds on them.
Ø Right of
rectification: individuals have the right to correct data that
is inaccurate or incomplete.
Ø Right to deletion
and right to be forgotten: in certain
circumstances, individuals can ask organisations to erase any personal data
that are stored by the organisations, including the Internet.
Ø Right of
portability: individuals can request an organisation to
transfer any data that it holds on them to another entity.
Ø Right to restrict
processing: individuals can request that an organisation
limiting the way it uses personal data.
Ø Right to object: individuals have the right to challenge certain types of processing, such
as direct marketing.
Ø Rights related to
automated decision-making including profiling: individuals can ask organisations to provide a copy of its automated
processing activities if they believe the data is being processed illegally.
You should also remind individuals that they are free to exercise their rights
and explain how they can do this.
9. YOUR DUTY TO INFORM COMPANY ABOUT CHANGES TO YOUR PERSONAL DATA
It is important that the personal data kept by the
company about you is accurate and current. Please keep us informed if your
personal data changes during your relationship with us.
10. CHANGES TO THIS DATA PROTECTION NOTICE
We reserve the right to update this data protection notice
at any time. If the COMPANY does update the data protection
notice, it will inform you and provide an updated copy of this notice by same
platform and our website.
