CLARIFICATION TEXT ON THE PROTECTION OF PERSONAL DATA
FOR PROSPECTIVE EMPLOYEES
Pursuant to Article 10 titled "Data Controller's Obligation to Inform" of the Personal Data Protection Law No. 6698 ("KVKK") published in the Official Gazette dated April 7, 2016 and numbered 29677, which aims to protect the fundamental rights and freedoms of individuals, especially the right to privacy, in the processing of personal data, and to the "Communiqué on the Procedures and Principles to be Followed in the Fulfillment of the Disclosure Obligation" published in the Official Gazette dated March 10, 2018 and numbered 30356; With this Clarification Text, we aim to inform you, our employee candidates, about your personal data processed as ERK PAZARLAMA VE GİYİM SAN. TİC. A.Ş. ("ERK PAZARLAMA" or "Company") located at Huzur Mahallesi Azerbaycan Caddesi No: 4 Skyland Istanbul D8 Block Bagimsiz Bolum No: 490 Sariyer / Istanbul as the data controller.
1. PROCESSED PERSONAL DATA
The following personal data are processed within the scope of your relationship with ERK PAZARLAMA;
Ø Your Identity Information: Name, surname, place of birth, date of birth, R.T.-ID NO, gender, nationality, marital status, military service information, driver's license information,

Ø Your Education, Work and Professional Life Data: Work history, educational background, professional competencies, interests and hobbies, interview and employment evaluations, references of the person specific to Business Life,
Ø Your Data on Family Status: Marital status, number of children,
Ø Your Data Regarding the Security of Our Company Campus: Data such as visitor records, entry and exit records to and from the facilities, in-house camera records
Ø Your Data on Audiovisual Recordings: Photograph
Ø Special Categories of Data: Personal health information, information on disability, criminal convictions and security measures,
2. PURPOSE OF PROCESSING PERSONAL DATA
Within the scope of your relationship with ERK PAZARLAMA, your personal data is processed for the purposes of evaluating your job application and ensuring physical space security.
3. TRANSFER OF PROCESSED PERSONAL DATA
Your personal data may be transferred to domestic official institutions and organizations, law enforcement agencies, domestic business partners for the purposes set out in Article 2 of this Clarification Text within the scope of the provisions of the Law regarding the transfer of personal data domestically and abroad.
4. METHODS AND LEGAL REASONS FOR COLLECTING PERSONAL DATA
Your personal data are collected, stored and processed during the establishment of your business relationship with ERK PAZARLAMA and during the continuation of the said relationship, from you, third parties and legal authorities, via the internet, telephone, e-mail and physical, written, verbal and electronic media for the purposes stated above, based on the reasons for compliance with the law listed in Articles 5, 6 and 8 of the Law and listed below.

Ø Provided that it is directly related to the establishment or performance of a contract, it is necessary to process the personal data of the parties to the contract, to provide the requested products and services and to fulfill the requirements of the contracts you have concluded,
Ø Fulfillment of our legal obligation as data controller,
Ø It has been made public by the person concerned,
Ø Data processing is mandatory for the establishment, exercise or protection of a right,
Ø Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
Your special categories of personal data are collected, stored and processed based on the following grounds of lawfulness:
Ø Your explicit consent,
Ø Personal data other than health, without seeking explicit consent in cases stipulated by law,
Ø Personal data relating to health can only be processed for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, by persons or authorized institutions and organizations under the obligation of confidentiality, without seeking the explicit consent of the data subject.
5. RIGHTS OF THE DATA SUBJECT WHOSE PERSONAL DATA IS PROCESSED
In accordance with the provisions of Article 11 of the Law, you have the following rights in relation to your personal data.
Ø Learning whether personal data is being processed,
Ø Requesting the information if their personal data has been processed,
Ø Learning the purpose of processing personal data and whether they are used for their intended purpose,
Ø knowing the third parties to whom personal data are transferred domestically or abroad,
Ø Requesting the correction of personal data in case of incomplete or incorrect processing,
Ø Requesting deletion or destruction of personal data,
Ø In case of correction, deletion or destruction of personal data, to request notification of these transactions to third parties to whom personal data are transferred,
Ø Objecting to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
Ø In case of damage due to unlawful processing of personal data, to demand compensation for the damage.
